Dashboard cameras now appear in a substantial share of commercial and passenger vehicles. When one captures the moments before a crash, the footage can corroborate your client's account, contradict the defense narrative, and lock down a liability picture that is otherwise hard to reconstruct. Getting that footage in front of a jury, however, requires deliberate work from the day after the crash through trial.
Authentication: What the Rule Actually Requires
Under Federal Rule of Evidence 901 and its state equivalents, authentication is satisfied when the proponent produces evidence sufficient to support a finding that the item is what the proponent claims. For dashcam video, courts have accepted authentication through several pathways.
The most common is the testimony of the person who reviewed the footage shortly after the crash and can attest that it fairly and accurately depicts the scene. If your client retained a copy of the file, ask them to describe what they observed on the footage when they first reviewed it, and compare that description to the exhibit. Courts treat this the same as a lay witness authenticating a photograph.
For commercial vehicle dashcams connected to fleet management systems, the authentication chain is different. You will need a custodian of records from the carrier or the telematics vendor to testify about how the system captures, timestamps, and stores footage, and to confirm the specific clip was pulled from the system without alteration. Many modern systems embed GPS coordinates and velocity data directly in the video metadata. That metadata is independently authenticating because it is internally consistent with known crash data like weather conditions, posted speed limits, and the parties' locations.
Verify the file's hash value early. Most fleet telematics providers can generate an MD5 or SHA-256 hash for a video file at the time of export. If you secure that hash and the file you receive matches it, you have a strong argument that the footage has not been altered in transit.
The Best Evidence Rule and Compressed Copies
Dashcam systems routinely overwrite footage on a loop, often every 24 to 72 hours. When a crash occurs, the camera's internal storage card may have already begun overwriting nearby segments. What you receive is sometimes a compressed or re-encoded copy rather than the original proprietary file.
Under FRE 1002, the original recording is preferred, but FRE 1003 allows duplicates unless a genuine question is raised about the original's authenticity. As long as you can show the compression or re-encoding process did not alter the substantive content of what was captured, courts generally admit the duplicate. Request the original file format and the vendor's documentation of its encoding process. If the defense produces a MP4 downconverted from a proprietary format, push for the conversion logs.
Using Dashcam Footage to Defeat the Low-Speed Defense
Defense biomechanical experts routinely argue that a low-delta-V collision cannot produce the injury claimed. Dashcam footage can undercut that argument in several ways. First, the footage may show the plaintiff vehicle's pre-impact speed independently of what the EDR captured, giving your accident reconstructionist raw data to work with. Second, in cases where the defense claims there was a minor tap, footage of a visually significant impact event directly contradicts the "barely-a-bump" narrative.
Pair the footage with the electronic data recorder data under FMVSS 405 if the vehicle is equipped, and have your reconstructionist synchronize the two. The combination produces a timeline that is much harder for a defense expert to deconstruct.

Spoliation When the Defendant's Footage Is Missing
When the defendant drove a commercial vehicle with a dashcam and that footage is unavailable, spoliation doctrine gives you leverage. The analysis turns on whether the duty to preserve attached before the footage was overwritten.
Send a preservation demand letter the day the case comes in, or the day after if it is a weekend. Specify the dashcam, the fleet management account, the GPS/telematics data, the driver's phone, and the fleet management portal's log for that vehicle. Courts have found that a carrier's failure to suspend the automatic overwrite cycle after receiving a preservation demand supports an adverse inference instruction and, in egregious cases, terminating sanctions.
Gather evidence that the carrier knew about the crash promptly: the driver's accident report, the carrier's internal incident log, any communication with its insurer. If the carrier had notice and the footage overwrote anyway, the spoliation argument is substantially stronger. Some courts also consider whether the carrier had a litigation hold policy and whether it was followed.
Subpoenaing Fleet Dashcam Systems
When the defendant is a commercial fleet operator, the dashcam is almost certainly linked to a third-party telematics provider. Vendors like Lytx, Samsara, Netradyne, and SmartDrive hold footage in cloud storage that the fleet operator may not control directly after a certain retention period.
Serve a third-party subpoena on the telematics vendor as soon as you identify it. Carriers often disclose the vendor's name in their FMCSA filings or in the vehicle's ECM data. The vendor's retention period may be longer than the carrier's own system loop, particularly for event-triggered recordings (hard braking, forward-collision alerts) that the system flags and saves separately from routine loop footage.
Ask for all triggered event recordings within a window around the crash, not just the crash clip itself. Prior hard-braking events on the same route can establish driver recklessness or fatigue patterns that support a punitive damages argument or a negligent retention theory against the carrier.
