What California law requires of property owners

Under California Civil Code section 1714, people generally owe a duty of reasonable care to avoid injuring others, and courts apply that to property owners and occupiers. A claim usually has to show that a dangerous condition existed, that the owner knew or should have known about it, and that it caused the injury. Proof of how long a hazard existed, such as surveillance video or inspection logs, is often decisive, so prompt action matters.

Deadlines and public property

The general deadline for a personal injury lawsuit is two years. If the hazard was on city, county or other public property, a government claim must usually be filed within six months, and missing it can end the case. Photograph the hazard, report the incident in writing and keep your shoes and clothing as they were.

Choosing a lawyer

Look for a firm with experience in premises cases, which often turn on documents and video rather than dramatic testimony. Ask how many such cases the firm has handled and how it evaluates whether a case is worth pursuing.
