The dietary supplement industry operates under a regulatory framework that is fundamentally different from the one that governs pharmaceuticals. Under the Dietary Supplement Health and Education Act of 1994 (DSHEA), supplement manufacturers are not required to obtain FDA approval before bringing a product to market. The manufacturer is responsible for ensuring the product is safe, but the FDA bears the burden of proving a product is unsafe after it enters commerce. That structural difference, combined with a compliance environment in which current Good Manufacturing Practice (cGMP) enforcement is inconsistent, has produced a recurring pattern of contamination and adulteration that generates personal injury litigation.
Two Categories of Product Failure
Supplement injury cases fall into two distinct categories that require different evidentiary strategies:
Contamination: the product contains an unintended substance that was introduced through poor manufacturing practices or substandard raw ingredient sourcing. Common contaminants include pathogenic microorganisms (salmonella, listeria, E. coli in protein powders and meal replacement supplements), heavy metals (lead, arsenic, cadmium in herbal products, particularly those sourced from regions with high-contamination agricultural soil), and cross-contamination from shared manufacturing equipment where allergens or other supplement ingredients are present.
Adulteration: the product contains an undisclosed pharmaceutical or controlled substance that the manufacturer intentionally or negligently incorporated. The FDA's database of tainted supplements documents hundreds of products found to contain sildenafil or sildenafil analogs in sexual enhancement supplements, sibutramine in weight loss products (a withdrawn pharmaceutical associated with cardiovascular events), and anabolic steroids in sports performance supplements. Adulteration cases are typically the most legally straightforward: the presence of an undisclosed drug in a product labeled only as a dietary supplement is a manufacturing defect per se.
The cGMP Framework as Standard of Care
FDA's Current Good Manufacturing Practice regulations for dietary supplements are codified at 21 CFR Part 111. The regulations require manufacturers to establish identity, purity, strength, and composition specifications for each dietary ingredient; to test incoming raw materials against those specifications before using them in production; to test finished products to confirm they meet label claims; and to maintain manufacturing records sufficient to trace any product lot through the production and distribution chain. Failure to comply with Part 111 requirements is not automatically a per se negligence finding, but it provides a powerful framework for the standard of care argument: a manufacturer that did not test incoming ingredients, did not test finished products, or did not maintain batch records to allow lot-specific contamination tracing operated below the regulatory minimum applicable to every other supplement manufacturer in the market.
Obtain FDA inspection records (Form 483 observations and Warning Letters) for the manufacturer and the manufacturing facility as a first step in discovery. These records are publicly available through FDA FOIA requests and often identify the specific Part 111 deficiency that allowed the contamination event to occur. A Warning Letter noting that the manufacturer failed to establish finished product specifications or failed to conduct identity testing of incoming ingredients is probative evidence of both the standard of care breach and the manufacturer's knowledge of the deficiency.
Liability Theories
All three traditional products liability theories apply to contaminated supplement cases:
- Manufacturing defect: the product deviated from its intended design and specifications because of a failure in the production process. Microbial contamination and heavy metal contamination above specification are manufacturing defects. No design critique is needed; the product as manufactured differed from the product as intended.
- Design defect: the product's formulation or sourcing strategy was inherently risky. A supplement manufacturer that consistently sources herbal ingredients from regions known for high-contamination soil without implementing decontamination processing may have a design-level deficiency, even if each individual batch met the lax internal specification the company adopted.
- Failure to warn: the supplement lacked adequate warnings about contamination risks or contraindications with medications or medical conditions. Adulteration cases frequently involve failure to warn claims: the product contained a pharmaceutical-grade compound that interacted dangerously with a medication the consumer was taking, and no warning disclosed that possibility.
Third-Party Certification and the Standard of Care
NSF International, USP (United States Pharmacopeia), and ConsumerLab provide voluntary third-party certification programs for dietary supplements. An NSF Certified for Sport certification, for example, requires testing for hundreds of substances prohibited in athletic competition, as well as label claim verification and facility audits. A manufacturer who sought and failed third-party certification, or whose products were identified by ConsumerLab testing as failing to meet label claims, has additional evidence of the manufacturing defect. Conversely, a manufacturer whose products carry NSF or USP certification will argue that the third-party verification satisfied a higher standard than Part 111 requires and that the specific contamination event was not foreseeable despite the certification. The plaintiff's response is to examine what the certification scope covered and whether the contaminant at issue was within the scope of the testing performed.
Causation Challenges
Causation in contaminated supplement cases requires proof that the specific lot the plaintiff consumed contained the injurious substance and that the substance caused the claimed injury. Lot number identification from the product container, label, or product receipt is critical. Retain the product or a portion of it, or the container with the lot number, immediately. If the lot is still in commerce, obtain samples from the same lot through the retailer or online market for independent laboratory testing.
For adulteration cases involving pharmaceutical compounds, the causation pathway from the compound to the medical injury is typically well-established through the pharmaceutical literature, the FDA's recall documentation, and the treating physician's testimony. The more contested causation question is whether the plaintiff actually consumed the contaminated product rather than another supplement or medication. Obtain all supplement use history and all prescription and over-the-counter medication history from the plaintiff's medical records and direct interview before filing.
Individual Tort vs. Class Action
Supplement contamination cases can be pursued as individual tort actions or as class actions. Individual tort actions are appropriate when the plaintiff's injury is severe, specific, and directly traceable to the contaminated product. Class action treatment is appropriate when the contamination produced widespread harm of a more uniform nature (label misrepresentation, failure to meet labeled potency claims) where individual injuries are smaller and uniform proof of the defect is the primary challenge. Many contamination cases involve parallel tracks: a class action on the labeling and warranty claims alongside individual tort actions for the most seriously injured plaintiffs.
